However keep in mind that we also (especially around launch, when that trailer came out) did a lot of promotion of the game's soundtrack and its composers, and were quite clear about what was the actual soundtrack. I can see how it's possible to get the wrong impression about the game's music, if you view only that trailer. (We linked to this channel in the trailer's description on YouTube.) It exists in the trailer because we thought it was cool, and we were able to licence it appropriately. With regards to the music in the trailer: No, that track is not in the game. And Alex did not stop filing illegitimate DMCAs! (Thus demonstrating that our strategic analysis was correct.) But they were not able to recover legal costs. At least one of those companies did sue her, and won (which should give you a hint as to the overall veracity of her claims). Keep in mind that her DMCA-spree hit multiple other companies. As stated above: we would win, it would be expensive, and we would have a hard time actually collecting on any judgement (this is what "judgement proof" means). If she had sued us, we would have trivially defended the case. That would have been a hell of a lot simpler to explain.I can only speculate as to why she did not sue us. Originally posted by Krystalmyth:Judgement proof? You're implying she'd win if she had the funds to sue. I mean River City Girls is an objectively inferior sequel compared to RCRU and it has arrangements of the original soundtrack in the game. But I still feel like I've been incredibly mislead by this. Couldn't care less about her, good riddance. For all the transparency you show here, with stuff like the above, how are we to feel you're being all that honest?įor what it's worth, the new soundtrack is infinitely better than Mauer's. As of today, that launch trailer is STILL on the Steam Page, and on Youtube, and there is no way in hell someone would be able to discover this within the time a refund could be established, so that's misleading as hell. I went through a lot of effort to discover these disappointments. At no point does the classic boss music show up, and having now listened to the official soundtrack, it seemed you were given license to everything but these songs for some unknown reason, yet you used them in your marketing. You even featured the music from the steam house in the trailer at the end. Bosses show up (and run away, but whatever) and regular stage music is recycled. The Dragon Twins show, and no Double Dragon theme. None of the original soundtrack is in, even in arranged form Even the original track, so lovingly referred to at the start, is missing. As I found an old version of the game I discovered neither of these soundtracks honor ANY of the old music at all despite being advertised as such. The only reason I cared about about this at all was because I assumed the trailer music was a part of the replaced OST. Is there a reason, this trailer features music that apparently doesn't exist in any form, original or arranged in either soundtrack? This one here: That would have been a hell of a lot simpler to explain. Judgement proof? You're implying she'd win if she had the funds to sue. So you had to remove the music due to contractual issues. She wanted you to comply with some stipulation and in lieu of that to have her music removed. Rather than it simply being prohibitively expensive.įor option 1 to exist she'd have to have some merit, you can't just DMCA someone without some semblance of it. When that decision was made, one of the most harrowing things was that - if we did not pursue a lawsuit - people like yourself would assume that it was because we did not have a case. I refer you to our original statement, here: This was relatively cheap, compared to a lawsuit. Actually enforcing an injunction like "stop harassing people on the internet" in a civil matter is almost impossible.ģ) Just replace the music. Alex is effectively Judgement Proof, so we could not recover costs. Lawsuits are extremely expensive and can take years to resolve. Alex can continue this indefinitely and for free.Ģ) Sue Alex. Fan videos go down and we lose reputation and word-of-mouth (this also happened). RCRU goes down and we lose money (this happened). Alex keeps harassing and false-DMCA-striking both us and our fans. Seems she had a point in doing what she did after all.Options that were available to us:ġ) Do nothing. This is about as much as admitting guilt to me. Can't believe they gave Alex the precedence.
